NOTICE OF INTENT TO CONSIDER THE
ABANDONMENT OF A STREET RIGHT-OF-WAY
IN OKEECHOBEE GARDENS SUBDIVISION
NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Okeechobee County, Florida will hold a public hearing on Thursday, August 13, 2020 at 9:00 a.m. in the Judge William L. Hendry Courtroom, Room 270, Historic Okeechobee County Courthouse, 304 NW 2nd Street, Okeechobee, Florida. The purpose of the hearing is to receive public comments in consideration of a petition to abandon a portion of a street right-of-way in Okeechobee Gardens subdivision, and which is further described as follows:
A PARCEL OF LAND IN SECTION 13, TOWNSHIP 37 SOUTH, RANGE 35 EAST, OKEECHOBEE COUNTY, FLORIDA, BEING A PORTION OF OKEECHOBEE GARDENS AS PER PLAT THEREOF RECORDED IN PLAT BOOK 2, PAGE 30, PUBLIC RECORDS OF OKEECHOBEE COUNTY, FLORIDA, SAID PARCEL IS DESCRIBED AS FOLLOWS:
BEGIN AT THE SOUTHEAST CORNER OF LOT 26, BLOCK 42, AS SHOWN ON SAID PLAT OF OKEECHOBEE GARDENS; THENCE N00°00’49”E, ALONG THE WEST LINE OF THE 60 FOOT WIDE RIGHT-OF-WAY FOR NE 46TH TERRACE (SHOWN AS F AVENUE ON SAID PLAT OF OKEECHOBEE GARDENS) AND A NORTHERLY PROLONGATION THEREOF THROUGH THE 60 FOOT WIDE RIGHT-OF-WAY FOR NE 11TH LANE (SHOWN AS SIXTEENTH STREET ON SAID PLAT OF OKEECHOBEE GARDENS) AND THE 15 FOOT WIDE ALLEYS RUNNING THROUGH BLOCKS 39 AND 42 AS SHOWN ON SAID PLAT OF OKEECHOBEE GARDENS, A DISTANCE OF 620.56 FEET, TO THE NORTHEAST CORNER OF LOT 1, BLOCK 39, AS SHOWN SAID PLAT OF OKEECHOBEE GARDENS; THENCE N89°55’16”E, ALONG THE AN EASTERLY PROLONGATION OF THE SOUTH LINE OF THE 60 FOOT WIDE RIGHT-OF-WAY FOR NE 12TH LANE (SHOWN AS SEVENTEENTH STREET ON SAID PLAT OF OKEECHOBEE GARDENS), A DISTANCE OF 60.00 FEET, TO THE NORTHWEST CORNER OF LOT 9, BLOCK 40 AS SHOWN THE SAID PLAT OF OKEECHOBEE GARDENS; THENCE S00°00’49”W, ALONG THE EAST LINE OF THE 60 FOOT WIDE RIGHT-OF-WAY FOR NE 46TH TERRACE (SHOWN AS F AVENUE ON SAID PLAT OF OKEECHOBEE GARDENS) AND A SOUTHERLY PROLONGATION THEREOF THROUGH THE 60 FOOT WIDE RIGHT-OF-WAY FOR NE 11TH LANE (SHOWN AS SIXTEENTH STREET ON SAID PLAT OF OKEECHOBEE GARDENS) AND THE 15 FOOT WIDE ALLEYS RUNNING THROUGH BLOCKS 40 AND 41 AS SHOWN ON SAID PLAT OF OKEECHOBEE GARDENS, A DISTANCE OF620.57 FEET, TO THE SOUTHWEST CORNER OF LOT 10, BLOCK 41 AS SHOWN ON SAID PLAT OF OKEECHOBEE GARDENS; THENCE S89°56’04”W, ALONG A WESTERLY PROLONGATION OF THE NORTH LINE OF THE 60 FOOT WIDE RIGHT-OF-WAY FOR NE 10TH LANE (SHOWN AS FIFTEENTH STREET ON SAID PLAT OF OKEECHOBEE GARDENS), A DISTANCE OF 60.00 FEET, TO THE POINT OF BEGINNING.
A copy of this notice will be available for public inspection at the Community Development Department, 1700 NW 9th Avenue, Suite A, Okeechobee, Florida each weekday except holidays between the hours of 8:00 a.m and 4:30 p.m.
All interested parties and citizens shall have the opportunity to be heard at this public hearing. Any person deciding to appeal any decision by the Board of County Commissioners with respect to any matter considered at this hearing will need to ensure that a verbatim record of the proceedings is made and that the record includes the testimony and evidence upon which the appeal is based. County Clerk tapes are for the sole purpose of backup for official records of the Clerk.
